19. Quotations and Proposals

Progress payments may be required for larger projects.

Final payment is due before launch or transfer.

Subscription Services

Late Payments

21. Refund Policy

24. Intellectual Property

  • Internal tools

Portfolio Rights

We may display completed work in our portfolio unless restricted by written agreement.

25. SaaS License Terms

Software is licensed, not sold.

You receive a limited, non-exclusive, non-transferable, revocable license to use the platform during your subscription term.

You may not:

Third-Party Platform Compliance

29. Warranties Disclaimer

Unless expressly stated, services are provided "as is" and "as available."

We do not guarantee:

  • Uninterrupted service
  • Specific rankings or marketing results
  • Approval by third-party platforms
  • Error-free operation

We do not guarantee:

  • Approval of third-party API applications
  • Continuous availability of third-party APIs
  • Continued compatibility with TikTok or other platform APIs
  • Specific reach, engagement, or algorithmic performance of published content

Third-party platforms may change policies, permissions, algorithms, or API availability at any time without notice.

30. Limitation of Liability

To the maximum extent permitted by law, 6Foot5 Media shall not be liable for:

  • Indirect or consequential damages
  • Lost profits
  • Data loss
  • Business interruption
  • Third-party service failures

Our total liability is limited to the amount paid by the client for the relevant service during the preceding three months.

31. Indemnity

You agree to indemnify and hold 6Foot5 Media harmless from any claims arising from:

32. Service Suspension and Termination

We may suspend or terminate services for:

Amounts due remain payable.

These Terms are governed by the laws of the Republic of South Africa.

Any disputes shall be subject to the jurisdiction of South African courts.

36. Entire Agreement

This document, together with any proposal, quotation, or signed agreement, constitutes the entire agreement between the parties.

36.1 API and Platform Integration Disclaimer

Our platforms integrate with third-party APIs and services, including TikTok APIs, subject to the availability and policies of those providers.

6Foot5 Media is not affiliated with, endorsed by, or officially sponsored by TikTok unless expressly stated.

Users acknowledge that:

  • Third-party platforms may suspend or revoke API access
  • Features may change due to external platform updates
  • Platform approval processes are outside our control
  • Third-party outages or restrictions may affect functionality

We will make reasonable efforts to maintain compatibility and functionality where commercially practical.
